By engaging in any transaction with the Platform, you expressly agree to adhere to the provisions outlined in this Policy. It is imperative that you carefully read and understand this Policy. These Shipping Policy and any operating rules and policies posted on the Platform, including Mironova Art Terms and Conditions, Creator's Terms of Use, Dealer's Terms of Use, Dispute Resolution Procedure, Conditions of Sale, Return and Refund Policy, Privacy Policy, Content Guidelines constitute the entire legally binding agreement and understanding between us and our users, governing your access to and use of Platform (“Agreement”). For the purposes of this Shipping Policy: Mironova Art (referred to as either “Mironova Art”, “We”, “Us” or “Our”) refers to NobleArts OÜ, Harju maakond, Tallinn, Kesklinna linnaosa, Vesivärava tn 50-201, 10152. Products refer to the items offered for sale on the Platform. Order means a request by You to purchase Products from the Platform. Platform refers to the Mironova Art online Platform, accessible from www.mironova.art Service refers to the Services provided by Mironova Art through the Platform, including but not limited to all functions and features accessible through the Platform. User (referred to as either “You”) refers to the individual or a legal entity accessing or using the Platform. When you visit the Platform, you become our user. We divide the Users into categories so you can easily find details about the processing of your personal data.
By using the Platform you make these Terms valid and mutually binding for the parties, and you declare and warrant that:
II. Shipping Options and ResponsibilityAs part of our commitment to excellent service, sellers are entrusted with the responsibility of promptly and efficiently delivering sold items to clients. Mironova Art does not directly provide shipping services nor does it arrange shipment for any items sold through the Platform, except when Mironova Gallery is the seller. To explore the shipping options and methods offered by individual sellers, please refer to their product pages or profiles, where comprehensive information on shipping options is available. In instances where Mironova Gallery acts as the seller, we offer the following shipping options: a. Standard Shipping: A reliable and cost-effective solution, ensuring the secure and timely delivery of your Product. Shipping costs may vary depending on the size and destination of the Product. b. Express Shipping: Expedited delivery at an additional cost. Fees depend on dimensions, weight, and destination of the Product. Both Clients and Sellers are obligated to disclose all necessary information required for the import or export of the respective items. Shipping service providers may directly contact Clients and Sellers to facilitate the pickup and delivery of items. In the unfortunate event of an order being lost or damaged during shipment, the Seller will collaborate with the shipping services provider to address the issue. Moreover, the Seller assumes responsibility for: (i) Insuring shipments unless an alternative agreement has been previously reached among Mironova Art, the Seller, and the Client; (ii) Accepting (fulfilling) returns, refunds, or discounts for lost or damaged items; (iii) Covering return shipment costs and insurance in the event of a return. III. Shipping Time FramesAt Mironova Art, we are dedicated to ensuring the timely delivery of your order. Sellers are mandated to dispatch orders within 5 working days upon receipt of full payment from the Client. However, we recognize that exceptional circumstances, such as force majeure events including war, natural disasters, or illness, may arise. In the event that delivery is not initiated within the specified period, the Client is entitled to choose from the following options:
It's important to note that shipping timeframes are influenced by the chosen shipping service and method (standard, express, etc.), as well as the destination point. We endeavor to provide accurate estimates of shipping times based on these factors; however, Clients must bear in mind that these are only estimates and do not guarantee the exact dates of delivery. Regarding those orders stored within the Mironova Gallery storage facility, it is crucial to comprehend that delivery terms may experience disruptions due to the ongoing war in Ukraine. Delivery will be initiated, as is with other Sellers, within 5 days of the receipt of payment by the Client. The estimated shipping terms for each order may vary contingent on the selected shipping method and your geographical location. The Platform and the Sellers shall endeavor to provide an estimated delivery date during the checkout process; however, we cannot guarantee the absolute accuracy of this estimation. IV. Shipping DestinationsMironova Art facilitates the shipping of Creations to addresses within all countries except for Iran, Iraq, the Russian Federation, North Korea, Lebanon, Libya, Belarus, Afghanistan, Somalia, Sudan, South Sudan, Syria, Venezuela, Yemen, Zimbabwe, Congo, Liberia, Cuba, CAR, DRC, Haiti, Eritrea, and Turkmenistan. V. Shipping QuotesMironova Art will present shipping quotes based on information provided by the Seller and Client. These quotes are subject to change at any time. Mironova Art cannot be held liable for any errors or omissions made when transferring such information to the shipping service providers. Should a Client alter their delivery address after payment, Mironova Art reserves the right, at our sole discretion, to decline such changes and ship to the originally designated location. In the event that Mironova Art approves the alteration, additional shipping fees may be required from the Client. Sellers may also be required to cover additional shipping fees or fines in case Mironova Art or the shipping service provider determines discrepancies in the item’s description provided by the Seller, as such omissions may impact the cost of shipping. Full disclosure of all necessary information for importing or exporting the item is required from both the Clients and Sellers. Sellers are solely responsible for covering all warehouse, release, and storage fees. It's important to note that shipping quotes do not encompass customs fees and duties. VI. Export and Import RegulationsClients and Sellers should be aware that various product categories within the realm of art may be subject to import/export restrictions or require permits. These restrictions could apply to a wide range of items, including but not limited to antique and ancient artifacts, artworks containing gemstones and precious metals, pieces incorporating materials from protected plant or animal species, cultural heritage items, historical artifacts, and more. It is the Seller's responsibility to determine and obtain any permits required to export the relevant products. Similarly, the Client is responsible for determining and obtaining any permits necessary to import the specific product category in question. In the absence of mutual agreement between the Client and the Seller, any delay in obtaining or failure to obtain a required license or permit will not constitute grounds for canceling a sale or delaying payment of the Total Purchase Price for an order. Mironova Art shall not be held responsible for any direct or indirect damage or loss resulting from the confiscation of purchased items, transportation restrictions, or actions taken by government or public authorities. Mironova Art is not obliged to undertake any pre- or post-customs release actions, including but not limited to obtaining binding rulings, providing advice on liquidations, filing petitions and/or protests, or any other related matters. VII. Order ProcessingOrders are typically processed within 2–4 business days following the confirmation of your purchase. Once the order is prepared for shipment, a notification email containing a tracking number will be dispatched to you. This term is indicative. The exact term depends on the Seller, for whom Mironova Art takes no responsibility. VIII. Packaging and HandlingThe Platform is committed to safeguarding your Product during the shipping process. Each Product is meticulously packaged with protective materials and placed within secure containers. In the event you receive the Product with visible damage to the packaging, it is imperative that you promptly contact our customer support team. Please consult our Packaging Procedure for comprehensive details on how Mironova Art sellers handle the packaging of orders. IX. Delivery AcceptanceUpon receipt of your Product, please undertake a thorough inspection. Should there be any visible damages or discrepancies in your order, you must refuse the parcel and initiate its return to the respective Seller while still at the post office. Otherwise, you must contact our customer support within 24 hours of receiving the Item. It is essential that you take photos and/or make videos of any damage inflicted on the ordered items as evidence. Mironova Art will pass this material proof on to the Seller, or directly to the insurance provider in cases where Mironova Gallery is the Seller. You must also retain the original packaging in the event of returns. X. Release of Purchased ItemsThe Seller commits to relinquishing physical possession of any items to the Client within five (5) working days of confirming that the Client has paid the Total Purchase Price for the respective order. Additionally, the Seller agrees to promptly furnish Mironova Art with tracking details and any other pertinent shipment information, including documents, to enable the Platform to pass these details to the Client. It is the Seller's obligation to: i. promptly provide all relevant shipping details to Mironova Art once shipping has been initiated; ii. retain the shipping details for a reasonable period; iii. refrain from disclosing such details to any third parties. XI. Customs DutiesThe Client bears sole responsibility for maintaining all records required under customs and/or other applicable laws and regulations. Mironova Art is not obligated to undertake any pre- or post-customs release actions, such as obtaining binding rulings, providing advice on liquidations, filing petitions or protests, or addressing any related matters. It is incumbent upon the Client to carefully review all documents and declarations prepared for Customs and Border Protection, other government agencies, or third parties. Should the Client identify any errors, discrepancies, incorrect statements, or omissions on any declaration or submission filed by Mironova Art or the Sellers on the Client's, they are required to promptly notify Mironova Art. XII. Returns and RefundsDetailed information concerning returns and refunds can be found in our Return and Refund Policy. XIII. Shipping Fees and TaxesDelivery fees are not included in the total purchase price of the order. The delivery costs fluctuate based on the destination, chosen shipping service, and method. Shipping fees are non-refundable. Unless otherwise agreed upon by Mironova Art or the Seller, the Client bears responsibility for determining and covering all shipping, packaging, and transit insurance fees and costs associated with purchased items. It is also the responsibility of the Client to determine and pay any customs duties or taxes associated with international shipments. Should the Seller provide options for free shipping or reduced shipping fees, such details will be clearly stated on the respective product page and the Seller's profile. It is imperative for Clients to furnish a valid delivery address during checkout. Any changes to the delivery address or delays in confirming the address after payment may result in additional shipping fees, storage charges, or taxes. XIV. VAT CollectionIn compliance with the laws of Estonia and the European Union, Mironova Art will levy a VAT (value-added tax) on all sales conducted through its Platform for Clients residing within the European Union. Additionally, depending on specific conditions, such as surpassing designated thresholds and in accordance with various state laws, Mironova Art may also be required to collect taxes from Clients residing in the United States. XV. InsuranceThe Seller bears responsibility for insuring shipments unless an alternative agreement has been previously reached among Mironova Art, the Seller, and the Client, and covering insurance in the event of a return. In adhering to the insurance policy, Sellers should ensure shipments are adequately insured to protect against loss or damage during transit, with coverage reflecting the full value of the Product being shipped. It's crucial for Sellers to select reputable insurance providers with a proven track record of prompt and fair claims processing. Additionally, maintaining accurate documentation of insurance coverage for each shipment, including policy details and proof of payment, is essential. In the unfortunate event of loss or damage during shipment, Sellers should promptly file insurance claims with the insurance provider and fully cooperate with the claims process, providing any necessary documentation to support their claim. Mironova Art serves solely as the intermediary between the Seller and the Client and does not bear responsibility for compensating lost or damaged items, except in cases where Mironova Gallery acts as the Seller. While Mironova Art endeavors to facilitate the insurance claims process to the best of its ability, we cannot guarantee any specific outcomes. Clients, in turn, have the right to be fully informed about the insurance coverage for their orders, including the extent of coverage and any limitations or exclusions. Clients also have the right to file insurance claims in the event of loss or damage during shipment, with Mironova Art and the Seller providing guidance and support throughout the claims process. Clients should expect timely resolution of insurance claims, including compensation for any loss or damage incurred during shipment, and Sellers should work diligently to facilitate the claims process and ensure Client satisfaction. Mironova Art is not liable for negotiating with the insurance provider on behalf of the Client. The Client acknowledges that all decisions communicated by Mironova Art from the insurance provider are final and binding, without the option for appeal, challenge, or reversal. XVI. Mironova Art’s RoleWhile Mironova Art may often provide support throughout the shipping process, including facilitating communication or payment between Clients, Sellers, and Shipping Service Providers, passing on tracking details to the Clients, as well as offering consultations on shipping matters, such assistance is offered for convenience purposes only and do not imply any representation, warranty, or assumption of liability on our part. We do not act as the agent of any Client, Seller, or third party, particularly concerning shipping matters, packing, or handling of any items. Mironova Art does not exercise control and holds no direct or indirect liability for the policies, acts, and omissions of the Seller or Shipping Service Provider regarding shipping, packing, or handling matters, whether or not such actions are recommended by us. Unless otherwise agreed upon in writing by Mironova Art or if Mironova Gallery is the seller, we do not arrange delivery and bear no responsibility for the packing, handling, pickup, shipping, fulfillment, and delivery of any purchased property. Moreover, unless expressly agreed to in writing by us, we do not assume custody, physical possession, risk, or responsibility for any item at any point. In any case Mironova Art is not responsible for any shipment delays due to weight problems, weather, customs, or any other circumstance beyond our reasonable control. XVII. Amendments to the Shipping PolicyThe Platform retains the right to modify this Shipping Policy at any time. Changes will be conspicuously posted on the Platform, and the effective date shall be updated accordingly. By engaging in a transaction with Mironova Art, you unequivocally consent to abide by the terms of this Shipping Policy.
